Delhi Maintenance & Welfare of Parents and Senior Citizens Rules, 2009 — Rules 22(3)(1), (4) Eviction from property/residential building of senior citizen/parents — Application maintainable even without grievance regarding non-maintenance as well as ill-treatment — Failure to provide necessary particulars for establishing case of HUF property — Court is prima facie of view that case set up by petitioner that property in question is HUF property is a ruse and not sustainable — Notwithstanding such claim, petitioner cannot resist ejection from property in question — Observations made regarding Rule 22(3)(1) as introduced by Amendment Rules, 2016 and substitution of Clause (i) by Amendment Rules, 2017 — Ample material that respondent No. 3 was distressed by conduct of petitioner and his wife — Respondent No. 3 has a right to live peacefully — This Court finds no infirmity with impugned order passed by Divisional Commissioner.
